Do I need a lawyer to buy property in Dubai?
The Dubai Land Department registers the transaction, while the broker typically receives a commission from the developer. Neither is responsible for examining what you are committing to under the contract, the total cost of the transaction or what happens if the handover is delayed. This is where independent legal due diligence comes in, before you pay the purchase price.
Can I resell an off-plan property after paying 30–40% of the purchase price??
There is no general “30–40% rule”. Dubai Law No. 13 of 2008 allows the transfer of off-plan property registered in the Oqood system. However, when a transfer is permitted and under what conditions depends on the specific developer agreement and the developer’s own procedures.
Is my money safe in an escrow account?
An escrow account is an important protective measure, but the bank does not guarantee that the project will be completed on time or that the property will be handed over in accordance with the contract. It does not replace due diligence on the developer, the project and the contract.
Does buying property in Dubai entitle me to a residence visa?
Not automatically. Eligibility depends on the property’s value, its financing arrangements and the ownership structure. A residence visa can be an additional benefit of a well-chosen investment, but it comes with various rights and obligations that should be assessed in advance in every case.
If I establish a company in Dubai or obtain a residence visa, will my Hungarian tax obligations cease?
Not by itself. Property ownership, residence visa status and tax residency are three distinct legal matters. Tax residency depends on factors such as how many days you actually spend in the UAE, where your home is, where your family lives, where your economic interests are centred, and what the double taxation agreement between the two countries provides.
What happens to my Dubai or UAE assets if something happens to me?
Your family will also need to take steps in the UAE. Once the bank becomes aware of the account holder’s death, the account is frozen. In the absence of a will, the local court rules of the emirate where the assets are located may apply, potentially resulting in lengthy and costly proceedings for the heirs. A registered DIFC will provides a more predictable basis for handling the estate.
Do I need to live in the UAE to make a DIFC will?
No. The DIFC Wills Service allows non-Muslims, including Christian expatriates, to make a will governing their UAE assets. You do not need to live in the UAE or hold a UAE residence visa. Registration can also be completed remotely via video conference.
Do I need to travel to Dubai to handle the process?
Most of the process can be handled remotely from Budapest. Whether personal attendance is required for any particular step depends on the specific case, and we will discuss this with you in advance.
How does the consultation work, and how much does it cost?
We discuss your situation, objectives and the possible solutions. The consultation fee for UAE-related matters is HUF 55,000 + VAT. There is no obligation to engage me for any further legal work afterwards. I typically respond to enquiries within 5–10 hours.
Do you also provide legal assistance with Hungarian legal matters?
Yes. I draft and review contracts and other legal documents, and I also assist with employment law and trademark matters.
